These terms apply where firearms or shotguns are stored with Magnum Arms Practical Shooting by arrangement, following transfer, delayed collection, or otherwise left in our possession.
1. Storage Service
We provide secure storage of firearms and shotguns in accordance with our obligations as a Registered Firearms Dealer and in line with applicable UK law.
2. Charges
- Storage is charged at the agreed rate
- Charges accrue continuously while firearms remain in storage
- A minimum charge period may apply
3. Payment Terms
- Invoices are payable within 14 days unless otherwise agreed in writing
- Charges continue to accrue until firearms are lawfully collected, transferred or disposed of
- Firearms will not be released until all outstanding amounts have been paid in full
4. Lien
We retain a lien over all firearms in our possession until all outstanding charges and related amounts due have been settled in full.
5. Default
An account may be treated as being in default where charges remain unpaid beyond the agreed payment period.
Without limiting our rights, the following escalation may apply:
- 30 days overdue: account considered in default
- 60 days overdue: final demand may be issued
- 90 days overdue: enforcement action may commence
6. Sale for Non-Payment
Where charges remain unpaid for more than 90 days, we may issue written notice of intention to sell.
Such notice will:
- Be sent to the customer’s last known postal and/or email address
- Provide not less than 60 days to remedy the default
If payment is not received within that notice period, firearms may be sold by us as agent of the owner, in accordance with UK law.
Any sale proceeds will be applied in the following order:
- Outstanding storage charges and any other sums due
- Reasonable administrative, handling and sale costs
- Any remaining balance held on behalf of the owner
7. Release of Firearms
Firearms will only be released where:
- Valid certification is produced where required
- Identity verification is completed
- All outstanding invoices and charges have been paid in full
We reserve the right to refuse release where any of the above conditions are not met.
8. Uncollected Firearms
Where firearms remain uncollected and the owner cannot be contacted, we may notify the relevant Police Firearms Licensing Department and take such further action as is reasonably necessary and lawful, including action under these Terms.
9. Liability
- Firearms are stored in accordance with RFD security requirements
- We are not liable for loss or damage except where caused by negligence or other liability which cannot legally be excluded
- Customers are responsible for arranging insurance where desired or required
10. Governing Law
These Terms are governed by the laws of England and Wales.
